Coal Mining Allowed Under and Adjacent to Dysart Woods
On March 5, Ohio’s Seventh District Court of Appeals affirmed the
decision by the Ohio Reclamation Commission to uphold the granting of a
permit allowing coal mining under and adjacent to Dysart Woods, one of
Ohio’s last old-growth forests and a National Natural Landmark.
A panel of three judges reviewed an extensive record of evidence from
the 2004 hearings before the Reclamation Commission where witnesses
gave testimony on issues regarding hydrology, forestry, and
geotechnical mining engineering.
